Overflight of Aircraft with a Special Category of Airworthiness (Including Landings within the Territory of the Czech Republic)

Permisssion for entry into the airspace of the Czech Republic is not required for aircraft that have been issued a Restricted Certificate of Airworthiness or a Permit to Fly by the aviation authority of an EU Member State, in accordance with Annex I (Part 21) to Commission Regulation (EU) No. 748/2012, as amended.

If the Permit to Fly is issued for the purposes listed under point 21.A.701(a), items 1, 2, 3, 4, 5, 8, or 16, the approved Flight Conditions must include and demonstrate compliance with all applicable requirements for obtaining an Authorization for the Performance of a Test Flight.
In such cases, copies of both documents (the Permit to Fly and the approved Flight Conditions) must be submitted to the Civil Aviation Authority (CAA) no later than three (3) working days prior to the intended entry into the airspace of the Czech Republic.

Permission is not required if the aircraft:

• holds a valid ICAO Certificate of Airworthiness; or
• holds a valid EASA Permit to Fly (EASA Form 20A or 20B) accompanied by the corresponding approved Flight Conditions (EASA Form 18A or 18B); or
• holds a valid EASA Restricted Certificate of Airworthiness.

Foreign aircraft registered in non-EU Member States that are issued a Certificate of Airworthiness other than a standard Certificate of Airworthiness (e.g. Restricted Certificate of Airworthiness, Permit to Fly, etc.) must obtain permission for entry into and for operation within the airspace of the Czech Republic.

The operator is responsible for submitting the application. The permission may be issued with a time or operational limitations, as applicable.

The application must include:

• the requested period of validity for the permission,
• the purpose of the flight,
• the intended destination aerodrome within the Czech Republic, or, in the case of overflight, the planned route through Czech airspace.

The application must be accompanied by copies of the following documents:

• Certificate of Airworthiness or Permit to Fly, including any associated operational limitations,
• Noise Certificate (if issued),
• Certificate of Registration,
• proof of validity of the Certificate of Airworthiness (if not indicated on the certificate itself),
• proof of third-party liability insurance coverage,
• Any additional relevant information (e.g. email or postal address to which the authorization should be sent — electronic delivery is possible).

All flights within the airspace of the Czech Republic, including arrivals to and departures from the territory of the CR, must be conducted in accordance with applicable regulations and procedures (see e.g. AIP GEN 1.2).
