Act No. 49/1997 Coll., on Civil Aviation, as amended, defines the Aircraft Register of the Czech Republic (hereinafter also referred to as the “Aircraft Register”) as follows:
The Aircraft Register is a register of civil aircraft (with the exception of sport flying equipment) operated by a natural person with permanent residence or by a legal entity with its registered office in the Czech Republic or, where applicable, in another Member State of the European Union (Sections 4 and 99a of Act No. 49/1997 Coll.).
Definition of an aircraft: An aircraft means a device capable of deriving support in the atmosphere from the reactions of the air, other than reactions against the Earth’s surface (Section 2(2) of Act No. 49/1997 Coll.).
The Aircraft Register is a publicly accessible register, and anyone is entitled to inspect it and request from the Authority a copy or an extract of the registered information, or confirmation that certain information is not registered in the Aircraft Register (Section 4(2) of Act No. 49/1997 Coll.).
The Aircraft Register is available to the public online.
Only an aircraft that is not registered in the Aircraft Register of another state may be entered in the Aircraft Register (Section 4(3) of Act No. 49/1997 Coll.).
By entering an aircraft in the Aircraft Register, the aircraft acquires the nationality of the Czech Republic (Section 4(5) of Act No. 49/1997 Coll.).
The Authority assigns a registration mark to the aircraft upon its entry in the Aircraft Register and issues a Certificate of Registration. The Certificate of Registration of an aircraft in the Aircraft Register certifies ownership of the aircraft (Section 4(6) of Act No. 49/1997 Coll.).
Except in certain cases, registration of ownership in the Aircraft Register has constitutive effect.
